  19. The obligation covered by this agreement is that the 
  20. above agrees to guarantee the obligation between τW(3) and τW(4)

  24. payable on τW(6).  In the event that it is not paid 
  25. when due, τW(4) shall notify the undersigned of same, and

  29. to τW(4) in full.  It is understood and agreed that the 
  30. primary responsibility for the payment shall be from 
  31. τW(3), and in the event that τW(3) does not 
  32. make such payment when due, τW(4) shall notify us at 
  33. which time we agree to make the payment.φ

  36. In the event that litigation is commenced to enforce 
  37. any of the terms of this agreement, the prevailing party 
  38. (whether by court or arbitration) shall be entitled to 
  39. the costs thereof, including reasonable legal fees.φß

  41. The undersigned shall be held fully responsible for 
  42. this obligation if not paid by τW(3) 
  43. in any amount whatsoever when the amount is due. Waiver 
  44. of any such payment from τW(3), 
  45. shall not release this obligation or constitute a waiver 
  46. against the undersigned either in whole or in part.φ

  48. On the happening of the following to τW(3), the holder 
  49. hereof may proceed against the guarantors if payment has 
  50. not been made by τW(3), even in the event that the money or 
  51. any part thereof is not due and payable: making of any 
  52. misrepresentation to τW(4) for the purpose of obtaining 
  53. credit or an extension of credit; any assignment for the 
  54. benefit of creditors; voluntary or involuntary 
  55. application for, or appointment of, a receipt; filing a 
  56. voluntary or involuntary petition under any of the 
  57. provisions of the federal bankruptcy laws; death; or, if 
  58. at any time in the sole discretion of τW(4) financial 
  59. responsibility of τW(3) shall become 
  60. impaired or unsatisfactory to τW(4).φφ
